About these terms

mtdvision.com belongs to MTD Vision, in Charlotte, North Carolina, United States. By using this website, creating an account or accepting a quote from us, you agree to these terms. If you do not agree, please do not use the website or our services.

Your account

• Give us true and current details, and keep them up to date.
• Keep your password to yourself. You are responsible for what is done with your account, so tell us at once if you think someone else has used it.
• If you open an account for a business, you confirm that you may act for it.
• We may close an account that breaks these terms, after telling you why when we can.

Quotes and our services

• Quotes. A quote describes the work, what it includes and its price. It is valid for the time it shows. When you accept it, it and these terms are our agreement for that work.
• Changes. If you want more or different work than the quote describes, we agree it with you first, in a new quote.
• What we need from you. The words, pictures, logins and decisions the work depends on, on time. Delays on either side move the dates.
• Your content. You confirm that you may use what you give us (texts, pictures, logos, data), and that it is lawful. It stays yours; we use it only to do the work.

Invoices and payment

Invoices show what is due and by when, and can be paid from your account. Prices are in US dollars unless the quote says otherwise. Recurring services such as hosting or support and care are invoiced for each period, ahead of it, until you cancel them; cancelling stops the next invoice.

Hosting and other providers

Some services rely on other companies: hosting providers such as Spotflixt, domain registries, email providers, payment providers and the App Store and Google Play. Their own terms apply to what they provide, and we are not responsible for their services. You are free to choose your own providers.

Our software

WBAMS and EraPOS are licensed under their own terms, on wbams.com and erapos.us. Using them as part of our services does not change those terms. What we build for you on top of them is yours to use for your business; the software underneath stays ours.

What is on this website

The words, pictures, logos and screenshots on this website belong to MTD Vision. You may read, print and share links to our pages, but you may not copy them to present as your own or use our names and logos without our permission.

Using the website fairly

Please do not try to break into the website or our systems, disrupt them, send spam or malware through them, or use them for anything unlawful. The same applies to websites and systems we host or look after for you.

Our promises and their limits

We do our work with care and skill, and we fix what we got wrong. Beyond that, the website and our services are provided as they are, and we cannot promise that they will never be interrupted. To the extent the law allows, we are not liable for indirect losses such as lost profits or data, and our total liability for a piece of work is limited to what you paid us for it. Nothing in these terms limits a right the law does not allow us to limit.

Governing law

These terms are governed by the laws of the State of North Carolina, United States. If we disagree about something, we will first try to settle it together; please write to us before anything else.

Changes

When we change these terms, we update the date at the top of this page. Work already agreed in an accepted quote keeps the terms it was agreed under.
